Assisting developers, from first steps through to completion, with large, complex projects in the private and public/private sectors, on fee simple, leasehold and Crown lands, including residential, commercial and mixed-use developments, conventional, air space and bare land strata subdivisions, planned communities, seniors’ housing and care facilities, clean energy facilities and infrastructure projects.

Analyzing, recommending and implementing creative partnership, limited partnership, joint venture and co-ownership structures for asset acquisitions and development projects; working closely with clients’ tax advisors to complete tax-driven real estate reorganizations.

Representing borrowers and lenders in connection with real estate financing transactions, including negotiating and closing acquisition, construction, take-out and permanent/term financing with financial institutions, mezzanine and private lenders, and deposit protection contract security.

Acting for landlords or tenants in: negotiating complex commercial leases (including subleases, assignments, consents and surrenders) for retail, office and industrial premises; advising on lease defaults, distraint, CCAA and bankruptcy procedures; creating standard form leases and related documentation; and ensuring compliance with the Residential Tenancy Act for landlords of large rental residential developments.

Acting for owners, managers, developers and operators in acquisitions, dispositions, financings, new development and management/franchise arrangements involving conventional and condominium hotels, ski and waterfront resorts, golf courses and fractional and time-share projects and offerings.

Advising developers on local government requirements in conjunction with zoning, subdivision, permit approvals, and other municipal and planning issues; compliance with Local Government Act, Community Charter and Vancouver Charter; negotiating with local governments to settle all forms of development agreements and advising with respect to bylaw interpretation and disputes.

Providing up-to-date and knowledgeable advice on compliance issues relating to the Real Estate Development and Marketing Act, Strata Property Act, Real Estate Services Act, FINTRAC Regulations and Guidelines, Builders Lien Act, Residential Tenancy Act, Land Title Act and Homeowner Protection Act.

Advising developers of run-of-river, wind and other clean energy projects with respect to real estate matters in the development and financing phases as well as zoning and other compliance issues with local governments and regional districts, and advising on government and utility-related infrastructure initiatives and public-private partnerships.
